Government & Smartphone Source Code Debate

Recent media reports suggested that the Indian government was considering a proposal requiring smartphone manufacturers to disclose their source code to third-party testing agencies and to inform authorities before rolling out major software updates. The government has denied making any final demand but confirmed that discussions are ongoing.

Why it matters:

  • Source code is the backbone of software systems and includes proprietary modifications made by companies.
  • Companies guard it closely for commercial secrecy and cybersecurity reasons.
  • Full disclosure could expose vulnerabilities, increasing the risk of cyberattacks and data breaches.
  • The proposal is linked to telecom security standards (ITSAR) under earlier frameworks like MTCTE, though smartphones are now mainly regulated under BIS certification after the Telecommunications Act, 2023.
  • Digital rights groups have raised concerns over lack of transparency in stakeholder consultations.
