Supreme Court Judgement on Teacher’s Eligibility Test
The Supreme Court’s September 1, 2025 judgment has made it mandatory for all in-service teachers from Classes 1 to 8 in non-minority schools to clear the Teachers’ Eligibility Test (TET) within two years, failing which they will face compulsory retirement.
The ruling has triggered widespread concern among States, particularly Tamil Nadu, which employs around 4.49 lakh teachers, of whom 3.9 lakh are non-TET qualified.
The State has filed a review petition, arguing that this order could lead to a collapse of the school system and violate Article 21A of the Constitution, which guarantees the right to free and compulsory education for children aged 6 to 14. The Court exempted teachers with less than five years of service left from taking the TET but made it mandatory for others. It also questioned the 2014 Pramati Educational Trust judgment, which excluded minority institutions from the purview of the Right to Education (RTE) Act, 2009, suggesting the need to revisit this exemption.
